These specific terms and conditions govern the "Receive Regularly" offer provided by LES NOUVEAUX MONDES (trading as Cafemalin), 30 rue de l'Escouvrier, 95200 Sarcelles, on the website www.cafemalin.comcafemalinThis offer is a subscription contract with no fixed term, as defined by the French Consumer Code; it is referred to hereinafter as "regular deliveries." These terms and conditions supplement the General Terms and Conditions of Sale, which apply to all matters not covered herein, and are intended exclusively for non-commercial individuals.
Regular deliveries allow you to automatically receive, at your chosen frequency, one or more consumable products from the catalog (coffee beans, ground coffee, capsules, pods, hot drinks, snacks, vending machine products), with a permanent 5% on the product's selling price on the day of each delivery. Machines and accessories are not available for regular delivery.
When a pack (a set of several units of the same product) is chosen for regular delivery, the delivery covers the corresponding quantity of units, billed at the unit price of the pack less 5%.
Regular deliveries can be set up from the product page by selecting "Receive regularly" and a frequency, then confirming the order. The first delivery is ordered and paid for immediately; subsequent deliveries are prepared and invoiced automatically on each due date.
An order has only one delivery frequency: all products in a single order that are regularly delivered are shipped together on the same date. To receive products at different frequencies, simply place multiple orders.
A customer account is required to manage regular deliveries. If the customer does not have one, one will be automatically created upon ordering; their login details will be sent to them by email.
The delivery frequency can be chosen from: monthly, every 2, 3, 4, 5 or 6 months. A frequency is suggested based on the weight or number of capsules ordered; however, the final choice remains flexible.
From the "Regular Deliveries" section of their account, the customer can at any time, free of charge:
Three days before each delivery, the customer receives a reminder email indicating the contents, price and date of collection, with direct links to postpone, change frequency or stop.
Each delivery is charged at the product's selling price displayed on the website on the day of delivery, less 5%, including VAT, excluding delivery charges. The price of regular deliveries therefore follows the product price.
The discount for regular deliveries cannot be combined with discount codes and promotional offers for the same product: a discount code cannot be applied to a product that the customer already receives via regular delivery, or has received in this way within the last 60 days, with the exception of codes expressly designated by LES NOUVEAUX MONDES as combinable. The code remains valid for use on other products in the order.
The price shown before subscribing is the price of the first delivery; the exact amount of each subsequent delivery is shown in the reminder email sent three days before.
Regular deliveries are offered in mainland Franceonly, excluding Corsica; Monaco and the overseas departments and territories are not served. Deliveries are made to your home (via GLS or equivalent carrier) at the current rate for delivery to a point , depending on the weight of the package (see the table on the Deliverydetails). Delivery is free for orders of €99 or more per delivery.
Delivery charges are calculated for each order based on the weight and value of the shipment. Estimated delivery times are listed on the Delivery page. The terms and conditions regarding returned packages (incorrect address, unclaimed package) apply to each delivery.
Regular deliveries are paid for exclusively by credit card (including via Apple Pay and Google Pay). The payment method is securely stored with our payment provider, Stripe; LES NOUVEAUX MONDES never has access to the full card number. By confirming their order, the customer authorizes the automatic debit of each delivery on its due date, for the amount indicated in the reminder email.
An invoice is sent by email for each delivery and remains accessible in the customer account.
If a payment attempt fails (expired card, limit reached, bank refusal), the customer is notified by email and the payment is resubmitted up to five times over the following seven days (approximately 12 hours, 24 hours, 2 days, 4 days, and then 7 days after the due date). Regular deliveries are paused in the meantime: no deliveries are prepared. The customer can update their card details from their account at any time; payment for the pending delivery restarts deliveries. If payment remains unsuccessful after these attempts, regular deliveries remain paused and can be stopped free of charge by the customer or by LES NOUVEAUX MONDES (Article 9).
If the customer subscribes to the Serenity Option (optional commercial guarantee described in the Terms and Conditions) when placing their order for regular deliveries, it is automatically renewed and billed with each delivery, at the current rate for the delivery amount, and covers the products in that delivery. It can be cancelled at any time from the customer account; cancellation takes effect from the next delivery.
If a product on a regular delivery schedule is temporarily out of stock when a delivery is being prepared, the delivery will be postponed for 7 days and the customer will be notified by email; no payment will be taken until the new date. If a product is discontinued, the corresponding regular deliveries will be stopped and the customer will be notified by email; no further payments will be taken. The customer can then set up new regular deliveries for a replacement product.
Regular deliveries are arranged for an indefinite period, with no minimum commitment. The customer can cancel them at any time, free of charge and without giving a reason, from the "Regular Deliveries" section of their account (clicking the "Stop my deliveries" button), or by emailing our customer service department. This cancellation constitutes termination of the subscription contract; in accordance with Article L215-1-1 of the French Consumer Code, it can therefore be carried out electronically, and LES NOUVEAUX MONDES will confirm receipt by email, indicating the date on which deliveries will end and its effects.
The suspension takes effect immediately: no further deliveries or payments will be made. Orders already paid for and shipped will be delivered as usual.
LES NOUVEAUX MONDES may stop regular deliveries in the event of discontinuation of the product (article 8), persistent failure of payment (article 6) or impossibility of delivering to the address indicated, after informing the customer by email.
In accordance with Article L221-18 of the French Consumer Code, the customer has a 14-day withdrawal period from the date of receipt of the first delivery (contract for the regular delivery of goods), under the conditions stipulated in the General Terms and Conditions of Sale: unopened products, complete and in their original packaging, prior request via the contact form, subject to the exceptions provided for in Article L221-28 of the same code (in particular, products unsealed after delivery which cannot be returned for hygiene reasons). The legal guarantees of conformity and against hidden defects apply to each delivery.
Customer data is processed for the purpose of fulfilling regular deliveries: order preparation and delivery, invoicing, payment processing (via Stripe), and sending service emails (pre-delivery reminders, price changes, out-of-stock items, payment failures, and cancellation confirmations). This data is retained for the duration of the regular deliveries and then for the legally required retention periods. Full details and customer rights are outlined in the Privacy Policy.
LES NOUVEAUX MONDES may modify these terms and conditions. Any modification will be communicated to the customers concerned by email at least 30 days before it takes effect; customers who do not accept the modification may stop their regular deliveries free of charge before this date. The applicable version is the one published on the website.
